Terms and conditions​

§1 Scope and subject matter
The following General Terms and Conditions conclusively regulate the contractual relationship between the University of Innsbruck, Innrain 52, 6020 Innsbruck, Austria, hereinafter referred to as "Organizer", and the respective participant(s) of the event "Skinnovation".
In any case, the realization of the event depends on reaching the minimum number of participants, and the organizer has set a maximum number of participants. The minimum age for participation in the event is 18 years.

§2 Settlement of the contract
The participant can purchase tickets for the event via the organizer's website (http://www.skinnovation.at/).
The offer to conclude a contract is made by the participant as soon as he/she has clicked on the "Buy now" button. Each participant is obliged to check his/her booking and payment details for accuracy before submitting the purchase offer by clicking the "Buy now" button and accepting the GTC as binding.
The purchase request is automatically confirmed as soon as the payment has been successfully made. The participant will then receive a digital ticket sent to the email address provided by him/her. This is considered an effective contract between the organizer and the participant. The participant will not receive any further tickets by mail or fax. He/she is responsible for keeping and carrying the tickets to the event. The participant will receive access to the Networking App of the event no later than 1 week before the start of the event, or if the ticket purchase takes place less than 1 week before the start of the event, then within 2 days.
The purchased tickets and access to the Networking App are personal tickets and authorizations. They are in the name of the respective participant specified during the order process. Tickets are only transferable to other persons in consultation with the organizer and provided that they correspond to the relevant ticket category. In particular, heavily discounted tickets may be excluded from transfer.
The minimum age (18 years) for participation must be confirmed by the participant at the time of ordering and must be proven at the start of the event upon request with an official photo ID.

§3 Price components and payment modalities
The ticket price does not include statutory sales tax. Universities, as legal entities under public law, are not enterprises within the meaning of § 2 UStG (German Turnover Tax Act) in their sovereign sphere and are therefore exempt from turnover tax.
Payment is possible either by credit card or by instant bank transfer. The total price of the order is due for payment immediately. Payment on account is also possible upon request.
Each event ticket is only valid upon full payment.

§4 Rights and duties
The organizer has the right to change the schedule, the content and the respective event locations at short notice. The organizer will, as far as possible, provide an equivalent replacement; in particular, he/she is also entitled to offer and hold parts of the event as an online event, insofar as this is possible. This does not entitle the participant to withdraw or cancel his/her ticket or to a refund of the ticket price. This applies to consumer transactions within the meaning of the KSchG if the change or deviation is reasonable for the consumer, especially because it is minor and objectively justified.
Furthermore, the organizer has the right to exclude a participant from (further) participation in the event of gross or repeated disruption of the event. In this case, the participant is not entitled to a refund of the ticket costs.
The participant assures that he/she actually meets the requirements (e.g. student, minimum age) for the ticket he/she has purchased. If the participant cannot prove his/her identity, cannot prove his/her age (minimum age), if his/her name does not match the names on the ticket, or if proof of a discount is missing (e.g. student), the organizer is entitled to refuse participation. The cost of the ticket will not be refunded in these cases.

§5 Liability
The information on the website of the organizer and in other media is provided without guarantee for topicality, correctness and completeness. Liability claims against the organizer, which refer to damages of material or immaterial nature caused by use or disuse of the information or the use of incorrect and incomplete information are excluded, unless the organizer in case of property damage is not intentional or grossly negligent fault. All information for still available participant places or tickets on the website of the organizer are non-binding.
The organizer expressly reserves the right to change or supplement parts of the event at short notice or to cancel parts of the event without replacement for important reasons. This applies to consumer transactions if the change or deviation is reasonable for the consumer, especially because it is minor and objectively justified.
Participation in the event Skinnovation is exclusively at your own risk. The organizer is not liable for personal injury unless he/she is at fault; in the case of damage to property, the liability of the organizer is excluded even in the case of slight negligence. The organizer is not liable for reasons of prevention, which can be assigned to the area of the participant and through which the participant suffers a disadvantage.

To attend the workshops and lectures within the event it is partly necessary to use alpine sports equipment (ski, snowboard, etc.) to get to the respective venue. However, skiing or snowboarding skills are not a prerequisite for attending the event as a whole. Participants without such knowledge agree not to attend the relevant parts of the event. In such a case, however, there is no entitlement to a reduction of the participation fee or ticket costs.

§6 Cancellation, cancellation by the organizer
In the event that the required minimum number of participants is not reached, the organizer may cancel the event. In this case, the participant will be refunded the full ticket price.
Furthermore, the organizer is exempt from holding the event or individual parts of the event in cases of force majeure or due to official orders that result in the cancellation of the event or parts thereof. Force majeure is defined as all unforeseeable, unavoidable events whose effects on the fulfillment of the contract are beyond the control of the organizer (e.g. natural disasters, lack of snow, weather conditions, technical breakdown of lift facilities, strikes, official prohibition). In case of partial or total cancellation of the event due to such reasons, the ticket price cannot be refunded.
The organizer will refund the ticket price to the participants in case of cancellation of the event necessary due to official order as a result of the Covid 19 diseases under the following conditions:
In the event of cancellation no later than 1 month before the start of the event, the entire ticket price will be refunded. In case of cancellation up to 2 weeks before the start of the event, 75% of the ticket price will be refunded. In case of cancellation within 2 weeks before the start of the event, 50% of the ticket price will be refunded.

Access to the Networking App and participation in the Pitch as well as the other parts of the event made available digitally or online shall remain available even in the event of (partial) cancellations due to force majeure or official orders as well as changes or (partial) cancellations within the meaning of § 4 paragraph 1.

§7 Cancellation by the customer
In order to prevent misuse and to ensure planning security for the organizer, as well as due to the costs for the event, which are sometimes incurred in advance, a cancellation of the respective event ticket free of charge is generally not possible.
For bookings made via distance selling (Internet), participants who are consumers are entitled to a statutory cancellation period of 14 days from the date of conclusion of the contract (see § 2), which is expressly pointed out to the participants when the purchase request is confirmed and the digital ticket is sent, together with the provision of the statutory cancellation form.
In case of a booking within 2 weeks before the start of the event (late booker), the participant expressly declares that he/she agrees to the start of the fulfillment of the contract by the organizer (provision of the networking app, start of individual events) before the expiry of the revocation period, and further declares to waive the right of revocation in the event that the entire Skinnovation event would already have ended before the expiry of the revocation period of 14 days from the conclusion of the contract (§ 18 para. 1 subpara. Distance and Outward Transactions Act). The right of withdrawal does not apply in principle if the event is provided in connection with leisure activities (§ 18 para. 1 item 10 Distance and Outward Transactions Act).

Apart from the right of cancellation, the following applies:
In case of cancellation within 14 days after conclusion of the contract, the entire ticket price will be refunded. In case of cancellation up to 1 month before the start of the event, 75% of the ticket price will be refunded. In case of cancellation up to 2 weeks before the start of the event, 50% of the ticket price will be refunded. In case of cancellation within 2 weeks before the start of the event, 25% of the ticket price will be refunded.
Once the event has started, the purchase price of the respective ticket cannot be refunded.
Tickets may only be passed on to third parties with the consent of the organizer. In principle, this is approved after consultation, but can be denied in individual cases without giving reasons.

§8 Data storage, photos and recordings
As the event is a global networking event, which also depends on the names of the participants, the participant agrees that his/her name and company is shared with the other participants. Other information such as email address or personal details are not shared. Participants will have the possibility to contact each other via a networking app where they can also set up a profile and supply further information about themselves and their business if desired.
Furthermore, the participant agrees that information/newsletters of the organizer will be sent to the e-mail address provided by him/her. A newsletter tool will be used for this purpose. If this is not desired, the participant can send an informal email to the organizer to be removed from the newsletter list.
Furthermore, the participant expressly agrees that sound, film and photo recordings of him/her may be made before and during the entire event and published, distributed and passed on by the organizer on the Internet, in the print media and other media.

§9 Final Provisions
These General Terms and Conditions and the respective concluded purchase contract shall be governed exclusively by Austrian law, excluding the conflict of laws rules.
The competent court in Innsbruck is agreed as the place of jurisdiction. In the case of participants who are consumers, this applies if their place of residence, habitual abode or place of employment is located in this jurisdiction.
Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
